Daha da \u00f6nemlisi, bu endi\u015felerin ortas\u0131nda Romal\u0131lar\u0131n orduyu yeniden aya\u011fa kald\u0131rmalar\u0131 i\u00e7in kaynak bulmas\u0131 gerekiyordu. \u00c7are olarak <em>plebs tribunus<\/em>u Gaius Oppius\u2019un getirdi\u011fi ve \u00f6zellikle kad\u0131nlar\u0131n birikimlerini hedef alan <em>lex Oppia<\/em> ad\u0131nda bir kanun \u00e7\u0131kar\u0131ld\u0131. Buna g\u00f6re kad\u0131nlar yakla\u015f\u0131k 30 gramdan a\u011f\u0131r alt\u0131n tak\u0131lar takamayacak ve renkli k\u0131yafetler giyemeyecek, ayr\u0131ca dini festivaller d\u0131\u015f\u0131nda \u015fehrin 1,6 km \u00e7ap\u0131 dahilinde atl\u0131 arabalarla seyahat edemeyeceklerdi (Liv. 34.1).<\/p>\n<p>Bundan 20 y\u0131l sonra, 195\u2019e gelindi\u011finde, \u0130talya\u2019daki Kartaca tehdidi ortadan kalkm\u0131\u015ft\u0131, fakat yasa h\u00e2len y\u00fcr\u00fcrl\u00fckteydi. D\u00f6nemin ola\u011fan\u00fcst\u00fc ko\u015fullar\u0131 alt\u0131nda belki de gerekli olan bu \u00f6nemlere mevcut ortamda art\u0131k ihtiya\u00e7 yoktu. Nihayet iki <em>plebs tribunus<\/em>u Quintus Fabius ve Lucius Valerius <em>lex Oppia<\/em>\u2019n\u0131n y\u00fcr\u00fcrl\u00fckten kald\u0131r\u0131lmas\u0131 i\u00e7in bir teklif verdiler. Bu hareketleri siyasette farkl\u0131 tepkilere neden oldu. Di\u011fer <em>plebs tribunus<\/em>lar\u0131 M. Iunius Brutus ve T. Iunius Brutus yasan\u0131n kald\u0131r\u0131lmas\u0131na izin vermeyeceklerini a\u00e7\u0131k\u00e7a belirttiler. Senat\u00f6rler yasan\u0131n aleyhine veya lehine konu\u015fmak \u00fczere s\u00f6z al\u0131rlarken Capitolium da yasan\u0131n destek\u00e7ileri ve kar\u015f\u0131tlar\u0131 taraf\u0131ndan doldurulmu\u015ftu. Ayr\u0131ca <em>lex Oppia<\/em>\u2019n\u0131n as\u0131l hedefi olan \u00fcst s\u0131n\u0131flardan evli kad\u0131nlar da (matrona) alana y\u0131\u011f\u0131lmaya ba\u015flad\u0131lar. Livius\u2019a g\u00f6re ne e\u015fleri ne de <em>magistratus<\/em>lar\u0131n yetkileri onlar\u0131 durdurabilmi\u015fti. B\u00fct\u00fcn sokaklar\u0131 i\u015fgal eden ve foruma giri\u015fleri engelleyen <em>matrona<\/em>lar yollar\u0131na \u00e7\u0131kan erkeklerden yasan\u0131n iptalini talep ediyor, tehlikenin geride kald\u0131\u011f\u0131n\u0131, \u015fehrin zenginle\u015fmeye ba\u015flad\u0131\u011f\u0131n\u0131 s\u00f6yl\u00fcyorlard\u0131. K\u0131rsaldan ve di\u011fer \u015fehirlerden gelen hemcinsleriyle artan kalabal\u0131k sonunda kons\u00fcller ve <em>praetor<\/em>lara ula\u015fmay\u0131 ba\u015fard\u0131.<\/p>\n<p>Senatodaysa M. Porcius Cato yasay\u0131 savunan bir konu\u015fma yapt\u0131. Konu\u015fmas\u0131 meselenin \u00f6z\u00fcnden ziyade kad\u0131nlar\u0131n Roma geleneklerine yak\u0131\u015fmayan protestolar\u0131na y\u00f6nelikti. Cato <em>matrona<\/em>lar\u0131 Romal\u0131 kad\u0131nlardan beklenen m\u00fctevaz\u0131l\u0131k ve \u00f6l\u00e7\u00fcl\u00fcl\u00fckle davranmad\u0131klar\u0131 i\u00e7in su\u00e7luyor, \u015fikayetlerini evlerinde kocalar\u0131na iletmeyip sokaklar\u0131 doldurmalar\u0131n\u0131 ele\u015ftiriyordu. Erkeklerin i\u015fi olan siyasete kad\u0131nlar\u0131n bu \u015fekilde m\u00fcdahil olmas\u0131ndan ho\u015fnut de\u011fildi ve as\u0131l istediklerinin s\u0131n\u0131rs\u0131z, denetimsiz bir \u00f6zg\u00fcrl\u00fck oldu\u011funu \u00f6ne s\u00fcr\u00fcyordu. Siyasete kar\u0131\u015farak erkeklerinkine denk bir konuma gelen kad\u0131nlar\u0131n ileride onlar\u0131n efendisi olmas\u0131n\u0131 ne engelleyecekti? Tutucu ve gelenek\u00e7i karakteriyle \u00fcnl\u00fc Cato\u2019nun as\u0131l derdi do\u011funun zenginli\u011fi ve egzotizminin etkisi alt\u0131nda kad\u0131nlar\u0131n l\u00fckse, g\u00f6steri\u015fe, kibire savrulmas\u0131n\u0131 engellemekti. Ona g\u00f6re Yunanistan ve Asya\u2019ya yay\u0131lan Roma, art\u0131k vatanda\u015flar\u0131n arzular\u0131n\u0131 uyand\u0131racak, i\u015ftahlar\u0131n\u0131 kabartacak her \u015feye sahipti. Ge\u00e7mi\u015fte Pyrrhos Romal\u0131 kad\u0131nlar\u0131 r\u00fc\u015fvetle kand\u0131rmaya \u00e7al\u0131\u015fm\u0131\u015f, fakat hen\u00fcz <em>lex Oppia<\/em> yokken bile kad\u0131nlar bunu reddetmi\u015fti. O zamanlar senat\u00f6rler b\u00f6yle bir yasa getirmeyi ak\u0131llar\u0131ndan dahi ge\u00e7irmemi\u015flerdi, zira k\u0131s\u0131tlamalar\u0131 gereken bir savurganl\u0131k veya l\u00fcks yoktu. \u015eimdi ise hastal\u0131k yay\u0131lmadan tedavinin uygulanmas\u0131 i\u00e7in yasa elzemdi (Liv. 34.2-3). Buna kar\u015f\u0131l\u0131k yasan\u0131n kald\u0131r\u0131lmas\u0131n\u0131 savunan Valerius, Cato\u2019nun yasay\u0131 tart\u0131\u015fmak yerine sadece kad\u0131nlar\u0131 azarlad\u0131\u011f\u0131n\u0131 s\u00f6yledi. Kendileriyle do\u011frudan ilgili bir yasa kar\u015f\u0131s\u0131nda kad\u0131nlar\u0131n s\u00f6z s\u00f6ylemesinin do\u011fal oldu\u011funa, bunu Cato\u2019nun iddia etti\u011fi gibi bir isyan, hatta <em>plebs<\/em>inkine benzer bir tepki (yani <em>secessio<\/em>) olarak tan\u0131mlaman\u0131n haks\u0131zl\u0131\u011f\u0131na vurgu yapt\u0131. Ard\u0131ndan da bizzat Cato\u2019nun eseri <em>Origines<\/em>\u2019te kad\u0131nlar\u0131n inisiyatifi ele ald\u0131\u011f\u0131 baz\u0131 olaylardan \u00f6rnek verdi. Toplumun her kesimi refahtan pay al\u0131rken kad\u0131nlar\u0131 bundan mahrum etmek ne kadar do\u011fruydu? Kocalar\u0131 erguvan giyerken kad\u0131nlar\u0131n giymemesi kabul edilebilir miydi (Liv. 34.5-7)? Kanun ola\u011fan\u00fcst\u00fc bir zamanda \u00e7\u0131kar\u0131lm\u0131\u015f ge\u00e7ici bir karard\u0131 ve Valerius da bunu vurgulamas\u0131na ra\u011fmen, Cato Roma\u2019n\u0131n ge\u00e7mi\u015fi ve de\u011ferlerine g\u00f6ndermelerle yasay\u0131 geleneksel bir metinmi\u015f gibi ele al\u0131yordu. Ancak rakibinin belirtti\u011fi gibi\u00a0<em>lex Oppia<\/em>\u00a0ne krallara kadar gitmekteydi ne de On \u0130ki Tablet\u2019e ge\u00e7irilmi\u015fti. Aksine zaman\u0131n \u015fartlar\u0131na g\u00f6re kaleme al\u0131nm\u0131\u015f yeni tarihli bir metindi.Ertesi g\u00fcn kad\u0131nlar \u00e7ok daha b\u00fcy\u00fck say\u0131larla sokaklara ak\u0131n ettiler ve yasan\u0131n kald\u0131r\u0131lmas\u0131n\u0131 engelleyen <em>plebs tribunus<\/em>u iki Brutus\u2019un evlerini ku\u015fatarak vetolar\u0131ndan vazge\u00e7medikleri s\u00fcrece yerlerinden ayr\u0131lmayacaklar\u0131n\u0131 s\u00f6ylediler. Bu kararl\u0131 eylemleri sonucunda kad\u0131nlar kendi klanlar\u0131nda yasa i\u00e7in oy kullanacak Roma vatanda\u015flar\u0131n\u0131 etkilemeyi ve yasay\u0131 kald\u0131rmay\u0131 ba\u015fard\u0131lar.<\/p>\n<p>Yasa alt\u0131n, g\u00fcm\u00fc\u015f, pahal\u0131 elbiseler gibi de\u011ferli kad\u0131n e\u015fyalar\u0131na y\u00f6nelik bir k\u0131s\u0131tlama getirdi\u011finden, olaylara kar\u0131\u015fm\u0131\u015f kad\u0131nlar\u0131n daha ziyade \u00fcst s\u0131n\u0131flara mensup olup olmad\u0131\u011f\u0131na bakmak gerekir. Roma\u2019n\u0131n se\u00e7kin kad\u0131nlar\u0131 elbette kendilerini <em>patrici<\/em> ya da <em>plebs<\/em> benzeri bir s\u0131n\u0131f olarak g\u00f6rm\u00fcyorlard\u0131; b\u00f6yle bir iddiada bulunabilecek konumda da de\u011fillerdi, ama sosyal stat\u00fcleri mu\u011flakt\u0131. Bu durum 3. y\u00fczy\u0131l\u0131n ba\u015f\u0131nda yarg\u0131\u00e7 Ulpianus taraf\u0131ndan da belirtilmi\u015ftir (<em>Dig<\/em>. 1.9.1):<\/p>\n<p style=\"text-align: center;\"><em>Kons\u00fcl mertebesinde bir adam\u0131n ayn\u0131 mertebede bir kad\u0131ndan ayr\u0131cal\u0131kl\u0131 oldu\u011fu konusunda kimsenin \u015f\u00fcphesi yoktur. Fakat praefectus kademesindeki bir adam\u0131n ayn\u0131 kademeden bir kad\u0131ndan daha ayr\u0131cal\u0131kl\u0131 olup olmad\u0131\u011f\u0131na bak\u0131lmal\u0131d\u0131r. Bana kal\u0131rsa \u00f6yledir, \u00e7\u00fcnk\u00fc erkek cinsiyetinde daha b\u00fcy\u00fck bir sayg\u0131nl\u0131k vard\u0131r.\u00a0<\/em><\/p>\n<p>Bu yoruma ra\u011fmen, antik kaynaklarda \u00fcst s\u0131n\u0131ftan kad\u0131nlara \u00f6zg\u00fc <em>ordo matronum<\/em> olarak ge\u00e7en kafa kar\u0131\u015ft\u0131r\u0131c\u0131 bir \u201cs\u0131n\u0131ftan\u201d s\u00f6z edilir. Bu \u201c<em>matrona<\/em> s\u0131n\u0131f\u0131\u201d Romal\u0131 se\u00e7kin erkeklerin mensup oldu\u011fu s\u0131n\u0131flar\u0131n bir taklidi gibi g\u00f6r\u00fcnmektedir, fakat bu anlamda resmiyeti olmad\u0131\u011f\u0131ndan net \u015fekilde tan\u0131mlanmam\u0131\u015ft\u0131r. Kaynaklarda \u201calt s\u0131n\u0131f kad\u0131nlar\u0131ndan\u201d farkl\u0131 olarak kabaca kamuda birlikte hareket eden evli \u00fcst s\u0131n\u0131f kad\u0131nlara \u00f6zg\u00fc bu terim, mesela Livius taraf\u0131ndan M\u00d6 3. y\u00fczy\u0131ln ba\u015f\u0131nda Pudicitia Plebeia festivali i\u00e7in toplanan se\u00e7kin <em>plebs<\/em> ailelerinden kad\u0131nlar i\u00e7in kullan\u0131lm\u0131\u015ft\u0131r. Plautus\u2019ta ise \u201cfahi\u015fe s\u0131n\u0131f\u0131\u201dna mensup iki azatl\u0131 kad\u0131n, se\u00e7kin <em>matrona<\/em>lar\u0131n meydana getirdi\u011fi kapal\u0131 topluluktan k\u0131skan\u00e7l\u0131kla \u015fik\u00e2yet eder (Plaut. <em>Cist<\/em>. 23 vd.; Liv. 10.23.10). Bu \u00f6rneklerden de anla\u015f\u0131laca\u011f\u0131 \u00fczere,\u00a0<em>ordo matronum<\/em> soylu ge\u00e7mi\u015f, zenginlik ve evlilik gibi \u00f6zellikleriyle senat\u00f6r s\u0131n\u0131f\u0131n\u0131n kad\u0131nlara \u00f6zg\u00fc paraleli olarak kar\u015f\u0131m\u0131za \u00e7\u0131kar. Bu kad\u0131nlar\u0131n da t\u0131pk\u0131 senat\u00f6rler gibi s\u0131n\u0131flar\u0131na \u00f6zel alametleri vard\u0131: Gelene\u011fe g\u00f6re, Coriolanus\u2019un Roma ku\u015fatmas\u0131n\u0131 kald\u0131rmaya ikna eden <em>matrona<\/em>lara senato taraf\u0131ndan (<em>stola<\/em>ya ilaveten) <em>vitta<\/em> (bir t\u00fcr sa\u00e7 s\u00fcs\u00fc ya da ba\u015f\u00f6rt\u00fcs\u00fc) ve erguvan elbise giyme, alt\u0131n tak\u0131lar takma hakk\u0131 tan\u0131nm\u0131\u015ft\u0131 (Val. Max. 5.2.1).
